Lawyer and Analyst

  • ASIC is seeking a full time Lawyer & Analyst to join their Assetless Administration Fund Team
  • Temporary (12 months) position based in Brisbane, Melbourne, Perth or Sydney

The team

ASIC’s Enforcement and Compliance Group (ECG) is responsible for the conduct of ASIC’s initial inquiries, compliance and enforcement work across all sectors excluding markets.  The ECG comprises Investigation and Enforcement Action, Enforcement Inquiries and Compliance, Enforcement Services and Enforcement Policy and Practice.

The Enforcement Inquiries and Compliance function is focused on the management of referral processes, the conduct of initial inquiries to assess potential misconduct, compliance activity, and referral of misconduct to other enforcement teams for enforcement action.

The Assetless Administration Fund (AAF) team also currently sits within (EI&C) and assess ‘complex applications’ for AA funding and oversees the administration of grants for liquidators of companies with few or no assets available for the liquidator to carry out full investigations and report to ASIC (Director Banning’ or ‘Matters other than Director Banning’ Grants) or take action to recover assets (‘Asset Recovery’ Grants).

The EIC AAF team assess complex AAF applications associated with ‘Matters Other than Director Banning’ and ‘Asset Recovery’.

The role

As a Lawyer you will review scopes in grant agreements ASIC enters into with Registered Liquidators under the AAF & provide legal support in relation to ad-hoc legal related issues arising from and associated with the AAF (including general AAF guidance, documentation review, and creation, modification, and analysis of AAF matter specific content).

As an Analyst you willassess AAF applications in accordance grant guidelines and internal procedures, prepare AAF agreements, including scope of works and assess quotes and eventual payment requests associated with funded applications and monitor Registered Liquidator compliance with the terms of AAF agreements, including adequacy of reports lodged with ASIC for compliance with the agreement.

You will also have opportunity to engage with ASIC key stakeholders and participate in at internal AAF forums / committees

About you

You should have a Bachelor’s degree in Law, admission to the Supreme Court of an Australian State or Territory as a solicitor or barrister and must hold (or be eligible to obtain) a current legal practicing certificate from the relevant State law society.

Post graduate studies in insolvency law and practice and qualification as an accountant (CAANZ or CPA) would be advantageous however not essential for applying to the role.

You will have experience in interpreting legislation, procedural manuals, and guidelines and practice experience in area of insolvency law and practice in a commercial environment is desirable.
